How Can a Landlord Legally Deliver an Eviction Notice?

A landlord legally delivers an eviction notice in writing by personal delivery to the tenant, or by state-approved backup methods that combine leaving, posting, and mailing. An eviction notice is the written warning that starts the fix-or-move clock before a landlord can file in court. A verbal tell-to-leave is not a legal eviction notice. The LegalClarity Team explains the required contents in its overview of written notice requirements, including names, address, reason, amount owed if any, and cure-or-move deadline.

What must be in the notice?

Courts require specific details to start the eviction clock. The notice must identify the tenants, the rental address, and the reason for termination. If rent is owed, it must state the amount and the deadline to pay, fix the problem, or move. For federally subsidized housing, the notice must be more exact.

It must be in writing, give the termination date, and state the reasons clearly enough to prepare a defense. It must also warn that enforcement happens only by court action. Tenants should read every line for missing facts. A notice without a date, address, or deadline is weak. Landlords should use the same checklist before delivery.

How is personal delivery done?

Personal delivery means handing the notice directly to the tenant. It is the first and safest option in most states. It leaves little room to argue about receipt. California orders residential service in three steps.

California Legislative Information publishes the three-step order in the full text of CCP 1162, starting with personal delivery to the tenant. Texas also allows in-person delivery to the tenant or to a resident age 16 or older. That direct handoff can satisfy the written notice to vacate. Keep a note of date, time, place, and who accepted it.

  • hand the notice to the tenant in person
  • if absent from home and business, leave it with a suitable-age person plus mail a copy home
  • if no place or person is found, post conspicuously plus deliver or mail

When can posting and mailing count?

Posting and mailing count when personal delivery and substitute delivery fail. The method varies by state, so landlords must follow the exact order. Skipping a step can void the notice. In New York, eviction petition service allows personal delivery, then delivery to a suitable-age person where admittance is obtained.

If neither works, the server must post conspicuously or slip the papers under the door and mail copies by both certified or registered mail and first-class mail within one day. The NY State Senate Open Legislation site details these petition-service rules in the text of RPAPL 735. In Texas, the pre-suit notice can be mailed by regular, registered, or certified mail to the premises. It can also be delivered in person plus affixed inside the main entry door. Texas Public Law reproduces the statute in the text of Property Code section 24.005, which requires at least three days' written notice to vacate before filing against a defaulting or holdover tenant unless the lease sets another period.

A phone call, text, or hallway warning does not start a case. Only the written notice described by law starts the clock. Tenants do not have to treat a verbal order as a court deadline. Self-help is also barred.

A landlord may not change locks, shut off utilities, or seize belongings to force a move. Federally regulated landlords may evict only by court action under state or local law, and Texas requires a Justice Court suit followed by a constable-executed writ. Tenants facing lockouts or shutoffs should seek local legal help quickly. Landlords who need possession must file and wait for a court order. Force outside that process creates new liability.

How should delivery be proved?

Proof turns a lawful delivery into a winnable record. Landlords should keep certificates of service, mailing receipts, tracking records, and photos of posted notices. Tenants should keep envelopes, postmarks, and photos showing when and how papers arrived.

New York requires the petition plus proof of service to be filed with the court within three days after service. Missing that filing window can stall the case. Both sides should calendar service dates, mailing dates, and filing deadlines on the same day papers change hands.
